A person affected by harassment or violence

A woman who faces a threat of harassment or violence, or who has suffered as a result of such conduct, is recognised as a person affected by harassment and violence.

She has the right to:

  • apply to the competent authorities, organisations or a court;
  • receive free legal advice and social, psychological, economic and medical assistance;
  • request a protection order;
  • report a breach of the protection order;
  • seek compensation for material damage and non-pecuniary harm through a court.

A survivor applying to court for compensation for material damage or non-pecuniary harm is exempt from paying the state fee.

Requesting assistance

Where there is immediate danger, the incident should be reported through 102. Advice and information are available through 112 or the 1146 helpline.

A report may be submitted by the survivor, her legal representative, another individual or legal entity, a public authority or an organisation.

After receiving an oral or written report, the internal affairs authorities must take urgent measures to stop the violence and prevent its recurrence.

Protection and social services

A survivor may receive a protection order, temporary shelter and medical, psychological, social and legal services.

If two or more reports of harassment or violence are made during one calendar year, the internal affairs authority must issue a protection order proactively.

A protection order is not required for daytime social, psychological and legal services from an Inson Centre. With her consent, a woman and her minor children may be placed in a safe shelter.

The National Agency for Social Protection may submit applications, complaints and claims without paying a state fee and participate in court through its representative to protect the survivor’s rights and lawful interests.

The procedure is governed by the Law on Protection of Women from Harassment and Violence, Cabinet of Ministers Resolution No. 3, Presidential Resolution No. PQ-175 and Cabinet of Ministers Resolution No. 354.
